Inconsiderate Driver Fined

SEQUEL TO ACCIDENT (Special to “Times.”) NAPIER, Jan. 26. Charged under the Motor Vehicles Amendment Act, 1936, with inconsiderate driving and with failing to report to the police forthwith an accident in which Dorothy Hindrup, of Napier, was injured, Charles Edward Cogni, of Napier, commercial traveller, appeared in the Napier Magistrate’s Court yesterday before Mr J. Miller, S.M., and was fined £1 on each charge, with 17/- and 10/- costs respectively. Constable B. Beck gave evidence of a telephone message from the defendant reporting the accident. He had been told that the accident should have been immediately reported. In a statement given to Constable J. Williamson, defendant stated that •he had taken every precaution to observe all the rules of the road, and denied offering to pay for the damage to the bicycle. Dorothy Hindrup gave evidence of au accident in which she was slightly injured. The driver of the car alighted and asked if she was hurt, and offered to pay for the damage to the bicycle. She was in the hospital for a week following the accident. Mr 14. B. G. Chadwick, who defended Cogni, stated that in regard to reporting the accident defendant did not realise that the injuries were extensive.

The Magistrate: Tho regulations provide that if there is any injury tho matter must be reported. In this case the injuries were spinal, and it is not for him to say whether they wero serious.

“This is a prosecution under the new regulation, and is meant for a big class of offence that was not covered before, and this, I think, is one of them,” His Worship added. “I don't think that the accident could have happened in the way tho defendant described.

“The cyclist states that she saw tin defendant passing, and that almost im mediately the vehicle swung over. Is regard to the second information, th< regulation applies to all injury, so tha the obligation is on the motorist in al cases, irrespective of injuries, to re port.*'
