In pursuance of the powers vested i:i it by the 339 th and 340 th Clause of Part 12 of " The Municipal Corporations A'-t, 1876," the Council of the Bo i o ugh of Palmerston North ordains the folo-wing additional Bye-law^ which shall come into force on the Ninlh diy of September, 1880:— :; CAEEIAGE OF GOODS. From and after the date of these bye-laws coming into operation, the dames of the bye-laws now m force m the Borough as hereinafter menlioned, shall bo, and tlw same- are. hereby repealed, namely, Clauses numUered 87, 88, 92, 93. The word " cart " shall, for the purposes of this bye-law, include every express, waggon, dray, or other such carnage, whatever be its construction, . Irawn by horses, or other animals, used vholly or chiefly for the carriage of Every cart plied for hire, and every night cart, shall be licensed by the Corporation. No cart shall ply for hire or carry goods for payment, either by contract or otherwise, within the Borough of LVmereton North, unless licensed m i hat behalf under this bye-law; and the driver for the time being of any cart plying for hire, "which: ■Hall" not be so licensed, shall be guilty of an SVrfenee ; and for every such license is«ued under this byo-luw the-e shall be'! paid to the Town Clerk the sum of 10s. f and the same shall be available only to the thirty-first day of March following the date of its issue. Every licensed cart shall have fixod on a conspicuous place on the off side thereof, a plate, with the word "licmse 1," and the number of license, painted m white letters on a black ground. Every person who shall empty, any privy, or load, carry, mnove, or deposit any nightsoil, offal, or other offensive refuse or matter, save between the hours appointed by the Cpuneil, or shall not deposit the same at such places as respectively shall have been appointed bj' some Regulation of the Council m, that behalf, or who shall use for any such purpose any cart or carriage not having a covering proper for preventing the escape of the cop tents of such caTt, or of the stench thereof, shall be guilty of an offence; and it shall be lawful for the Council from time to time to make regulations for appointing hours as aforesaid., IE the driver of a?iy cart shall leave the same unattended m any street, whether pnblie or private, or shall go for a distance of more than ten, yarda from the side of such cart, being m any such street, without passing through the near wheel or wheels thereof a suitable chain or chains, so as to effectually prevent the rotation of such' wheel or wheels, whether m any such case such cart be hired or not, such driver shall m every case be guilty of an offence and where such cart shall have' been, soleft unattended, any constable may drive away such cart, and deposit the Fame, with the horses harnessed there-, to, at some neighboring place bf'safe custody, notwithstanding the liability of such driver to a 'penalty for siieh 'fEence,. and all expanses occasioned .thereby j. shall be a liability ot the person" so i offending; V x I No.driver of any cart m any street* ' whether public r or (privates oi^in ajiy ; public place, shall feed aijy horaj at*'
