He might mention that he was present m Court when Mr. Purcell's claim against the Local Board— for damage caused by their neglect m allowing a certain drain to overflow on t6 his land — was preferred. Mr. Ward had then decided that County Councils «nd Highway Boards were the only bodies who Had control of drains and watercourses, quoting m support of this view the 170 th section o£ the Public Works Act; but on consulting Mr. Maclean as to this, ruling, that gehtlerdan had said that though m the SecI tion quoted, no mention '• was .made; of . Local Boards, yet the interpretation clause gave Local Boards powers similar to those 'enjoyed by Highway Boards . Under these circumstances, Local Boards had been included m the resolution passed. If they. were, satisfied with this view of the case, it only remained for them to confirm that resolution. . .
