MAGISTRATE’S COURT.

AIOTORI£T FINED. Ou a charge of being intoxicated while in charge of a motor-car, Huia Aliko Hakaraitr, of Kakariki, was convicted and fined £ls and was disqualified from driving until Alay, 1939, by Air R. AI. AA'atson, S.AI., at the Feiltling Alagistrate’s Court yesterday. Sergeant Angland stated that on Friday lust accused was found in Alanchester Street in a condition of intoxication, but not drunk enough to be arrested. He said he was waiting for his brother, who would be driving the car. The police left him, but later accused entered the car and drove off, to be stopped by the police, and when challenged as to bis condition, said: “I suppose ou are right.” He was then arrested. Accused admitted having partaken of five long beers, and there were three bottles of beer in the car. Air T. L. Seddon, who appeared for accused, said that be was a sharemilker and an excellent worker. He not only kept himself on bis earnings but also assisted in the upkeep of other members of the family, including bis parents. When he received hi-s cheque last week he had come into Feilding and met a few friends, and with them partook of liquor. In view of the recent remarks of the Minister of Transport on the subject of intoxicated motorists, counsel was diffident about offering suggestions as to extending leniency towards accused. He could say, however, that accused had not been in any trouble before, and if he were sent to prison it would create a hardship on members of his family. The Alagistrate said that it was very difficult to deal with such cases, and leniency could not he extended in view of the recent remarks of Judges and Alagistrates on the subject of intoxicated motorists. In this case he would not impose a term of imprisonment, but would fine accused £ls as well as cancel his existing license and prohibit him from obtaining a license until Alay, 1939. Time would bo allowed in which to pay the fine.
