KELLY v. FAKE,

In the case of A. Kelly, v. L J. F&keA • claim £501, on account of*the death-of-:" plaintiffs brother, Mr Cooke for defen-: _ dant, said the parties had come to an"'*' arrangement in the matter. They had a agreed that (1) judgment should be en-;?i tered for the • defendant without costs, < (2) the Court should be asked to assess'# the compensation due to the dependants '';/ of the deceased (J. D. Kelly), at £75, - which amount should be paid to tho' plaintiff for all dependants by the defendant, and accepted as full satisfaction' for all claims under "The Workers' Compensation Act."

.Mr Baldwin* signified ■ that' plaintiflr agreed to the settlement. ' " -; -

Mr Cooke said he wished to ensure that ( there would be no further claims from other dependants, and Mr' Baldwin said an undertaking Svould be given to thateffect. ■'-.-••

His Honor made an order that tho the sum of £75 be paid .to such of the dependants as the parties.may agree upon, and that failing.such agreement the amount to be paid to each shall be fixed by the Arbitration Court, .each party to pay their own costs.
