RYDER v. HALL. _F. F *der (Mr Morrison) v. C. and A. Hall (.Dr Findlay, with him Mr Atkinson.) Claim £501 damages, and injunction to restore water rights over plaintiffs land. ■V Evidence as to the state of the land and watercourses previous to the cutting of drams by the. defendants was given by additional" natives. and by Joseph D\Ath, who said it was absolutely certain water used to flow.; through tho natural water-courses, and they° weio never dry in the summer time. Plaintiffs land was very good, but its valuo was considerably affected by the deprivation of the water, particularly as "regarded the proportion devoted to market gardening. The land was affected to the extent;of.fully £10 per acre depreciation by the want of water.
