Alleged Assault.

TIMARU, September 27, Constable Alfred Brown, stationed at Temuka, was charged before the S.M. at Temuka to-daj with violently assaulting a man named D. Geaney, a stockagent at 11 p.m. on the 16th inst. Complainant swore that he went to the constable's house to make a complaint against another man, ana roused Brown out ol bed. Geaney alleged that Brown came to the aoor, ana without waiting to hear a word struck him a violent blow in the face, which blackened both eyes, at the same time ordering him to ro away. Geaney went to a neighbouring house and called up the owner, Lee. Ab Lee came out, Brown came up and attempted to arrest and handcuff Vxeaney, and .with Lee's help did so. Brown absolutely denied hitting Geanay at his own hoase; . Lee suggested that the damage-to Geaney's face occurred during resistance to arrest, and counsel for the defence suggested that the complainant wa3 too drunk to-"know exactly what happened.

The Magistrate concluded that the complainant had been drinking, and was also exeited'.by the matter he had to report to the constable, so that he rcould not conveniently say what hs wanted, and the bad language he used had led. t]ie:constable to arrest him.- His Worship remarked that he had made no complaint to Lee that the constable had struck him, but had only charged him ■with_being drunk. He concluded that the injuries were received during the arrest, and as the complainant had foolishly resisted arrest he had only himself to blame.

The ease was dismissed.
