BREACH OF B7S-LAW. R. C. Partridge was charged on two informations with a breach of th» ByeLaw, No 19, of the Railways Act, m obstrucling the stalionmasteo m the «ecation of his duly, by seizing his hand* while he wan iv the act of removing an obstruction from the railway premise*, tOt.wit the horse of the defendant which, it was alleged, was unlawfully occupying ground belonging to the Railway Department ; and also with nsjJDg insulting language to the said atationj master. A cross information for assault was laid between the- parties, it being alleged that the stationmaster seized the complainant by the throat and shock his fist m his face. \ Mr G. F. Hawkins, who appeared for Partridge, contended that the case was out of the jurisdiction of the court, on the grounds that a question *of .title would arise, according to.the statement otthe Constable, it ( not being known whether the' Department -had gazetted the ownership of certain land adjoiuii.g the station procured from the Corporation some time back. . . ; After consideration the Bench, oh the application of the Constable, decided to adjourn the hearing of the case to Tuesday week. The cross-intormation was allowed to be withdrawn, on the application of Mr Hawkins.
