THE PROSECUTOR S ABSENCE AC COUNTED FOR.

In the Resident* Magistrate's Court yesterday afternoon, Mr Jellicoa { mad* an explanation of the absence of his client, Mr McMinn, on the previous day* when Mr Edward Shaw's case was being tried. He was unable on the previou* day, he said, to explain the absence of ' his client, but he was now able to do ■*„. having discovered two telegrams ■ from Mr McMinn, both dated the 4th fnst. The first of these telegrams was m these words : " Been confined to bed by serious illness for several days. Very shaky, and dread journey, but hope to arrive m time." -The second message, sent, at six o'clock m the evening, was at follows : " State of health absolutely prohibits me? ' from attempting the journey to-day. If case remanded till Wednesday, coald come by Jane Douglas on Tuesday even. ing. Could not undertake journey ov*r~ land under present circumstances." Mr Jellio6e added that if he had had thos«' telegrams on the previous day h« could have explained Mr McMinn's absence. Mr Wardell said he had feH anxious to have some reason for McMinn's absence. Mr Jellicoe said he only returned oa, Monday from a holiday trip, and having ; had' to go through a mass of papers bY had missed the telegrams. Mr Wardell said telegrams ought not to be overlooked.
