Kemnant v. John Jones.— Claim £8 9s, for balance of wastes. Plaintiff stated he had been engaged for a few weekß by defendant, at the rate of 7s per day. Had workad m the South Island for 5 years for his father, working, from 12 to 16 hours. • Defendant would not pay him for any overtime and only for the days he had worked. He (Plaintiff) claimed to be paid for the work he had done overtime. Defendant contended he was only liable for lie days upon which the plaintiff worked for him and at 7s per day without any overtime. ■ " • '•■'.. After considerable time , : was taken up going into set offs, contra accountsf and various other documents b, figures, the Bench gave judgment; for plaintiff 8s 9d, as follows— ls days work at 7s per day, £5 5s less cash paid .£1 3,Qs and contra account £3 Os 3d defendant to pay costs also. •'.•, Brewery' Co. y. Hankins'for plaintiff, who gave evidence to selline the goods to Boyd now deceased, the defendant being his executrix. . Judgment for plaintiff and costs. Bichter & Co. v. P. Hankins fpr plaintiff, and Mr A. S. Baker for defendant. ■ ; Mr Baker asked the Bench to grant the defendant one month to pay the' amount m, and that m the meantime he apply for 'a re^hearing of the case as his client would be prepared to prove his. having paid the amount. Mr Hawkins objected and contended he could prove that the defendant was m a position to pay at once. . After an examination of the defendant by Mr Hankins the case was adjourned to next court day. The Court then adjourned.
