Saturday April 18. (Before Ais Honor Mr Justice Rich? tndnd.) ■'-, - , Cole v. Cole. . Mr Edward Shaw for thfl petitioner, ; Mills Cole. The suit was heard before his Honor the Judge, without a jury* Mr Shaw said the petitioner, Mills Cole, applied for a dissolution of hiß,v»&mage with Emma Colo. The partieß, were married at Greytown, m 1874, and soon afterwards they went to Blenheim. Mrs Cole left her husband m Blenheim, and had not cohabited with him since. Petitioner subsequently ascertained that his wife was living as a Mrs Watson, at Palmorston North. No defence was set up against the petition. Mills Cole, a laborer, deposed that he had been employed m the Raugitikei | district for the last seven or eight years. j Was married at Greytown m the year 1874 to Emma Cooper. About two months after the marriage witness went t» Blenheim with his wife. In 1875 a child was boru, and that was the only issue of the marriage. His wife had lived with him for about three years when, m 1877, being then m the Rangitikei district, his wife left him taking the child with her. They were not living happily together, and '. she left him, after telling him of her intention to do so. Had never lived with her as man and wife since. Made inquiries about her, but could find no trace of her. By his Honor :-— I was jealous of her and she of me, Had several times caught men m the whare who- had no business there. Between ten and twelve months ago witness was m Palmerston North at a race meeting, and m consequence of what he heard there, he went to see his wife, and found her living under the name of Watson. She. admitted that she was living with Watson as his wife. Was unable at that time to take the necessary proceedings. Was present m Mr Shaw's office when his wife said she had no defence to this action and did not intend to raise any. Sarah Bassett, a married woman, residing at Petone, deposed that some tiui3 ago she was residing m Palraerston North, Mrs <Jole, the -respondent, was living there with nlr Watson as. his wife. Knew her name was Cole^because witness sold her a cottage, and the convey- . ance was made out m the; name of Emma Col*. His Honor thought it was a case where a decree nisi should be granted; and granted the petition accordingly.
