Edward Jones was charged with having on the 7th instant, unlawfully assaulted . and beaten his wife. • : I Constable Manning appeared under the Police Offences Act to. prosecute. ; Accused was represented by Mr J. H. j Hawkins- j Dr Ma^cintire gave medical testimony •; to the effect that he had attended the j woman bidnging this action, and found i that she had sustained a . contusion be- j hind her s right ear j in 1 a y dangerous ■■ position, hut no dangerous symptoms were apparent. '■■ .' - , v Maty Jones; Wife Of the accused,' deI posed to haying been struck by her hus- ■ band on the 7th; instant. She admitted ; m cross-examination that she gave some provocation for the. assault. She stated ; that . on Saturday , evening she dragged her husband,, who was the worse for ; liq,uor,' ' out ,of a hotel, and that he managed to get a^ay from her; and ; that she pelted stbnesat him 6n thefol- ; lowing ' Mdiidky morning. ' She went ; away to Fading and returned on the 7th I instant, when they had '• some words ; : together,' and. he struck her. .. t i Mr Hawkins pointed out to the Bench : !that all the informant i wished was to' \ have her husband bound over to keep the peace, and that the indictment be alteredrto this.; : . : ,; . ■ . ' The constable stated that the best way ; to effect this would be to give the accused ; three months, and further pressed that the case of assault be proceeded with. . Mr Hawkins objected, stating that if the man and wife had come to' an ! amidaole agreement, the 1 charge should not be . pressed, , and he therefore asked the Bench, to. merely bind the accused : over to keep the peace. i The 'Biedach consented to the' application, and ordered that the accused be : bound over to keep the peace for six i months, in' two sureties of i'2s each, and ihis own recognisance of i!2s— iS7s m all. 'Messrs Bichard Smith and E. K. Bishop j entered into the necessary bonds for the ■accused.
