" Smeils" ExcraordiNARY.

(BY UELEGHAPH.) (united press association) Dunedin, This Day. At the Police Court yesterday, the Borough Council ot Roslyn suburb proceeded against James Durson, soap boiler and bone dust manufacturer, for bavin jr premises which were a nuisance. The Town Clerk explained that the proceedings were taken under the Pub* lie Health Act m consequence of a petition by residents. He said, ot his own knowledge, that the smelis could be noticed 100 yards away, according to the direction of the wind . There were at least three distinct smells — (1) Of ground bones : (2) of melting tallow : (3) of storage of refase. Some witnesses said the smells caused water m tanks to become stagnant, that they could be " cat with a knife," and that only the Government Analyst could tell what they really werelike.The defendant admitted that to most people the smells from hid premises was offensive ; he had lived beside it for years, and had done well on it, but people who were not educated tip to it did not relish it. Medi6al evidence was given that, while the smells were decidedly unpleasant, ' they weie certainly not injurious to health, aud a witness m the trade said the smell purified the air, and, was something like that of a prime Dutch cheese. The defence was that the best practicable means were used to abate the nuisance, and the Magistrate said this waa proved. He dismissed the case on the ground that, thereawas no statutory penalty for it.
