Mr Tricklebank's COMPLAINT.
At the special request of Mr C. Trioklehank, we publish the following letter, which was read to the meeting of the Borough Council last Tuesday evenin* :— Palmerston North, May 11th, 1883. To the Borough Oounci*. Gentlemen — This is the last application I shall make to you for redress. I purchased my present freehold land m the Boroueh.of Palmerston North under a special Preventive right, given by the Provincial Government of Wellington, by a direct order from Dr Peatherston, superintendant of Wellington ; and furnished to me by Mr G. M. Rnelson, ami J. T. Stewart, on conditions that I would establish a brickyard to assist the purchasers of land, who Would become settlers to build m town and country. In conforming with my promise I chose the present site formy brick yard, owing to the good natural drain, then open, keeping my brickyard m good : working order. In 1872, J. T. Stewart instructed : Mr A. Burr, manager of the work, to turn the drain of a la>ge part of railway' line at Terrace End out of its former' course, that ran across the wood through P. Mausou's land, to the Manawatu River. J. T. Stewart yielding to P. Manson's unjust claims, advised A. Burr to turn the drain down through Palmerston. Mr Al Burr informs me he reiused to take the drain the wrong way through the township, until P. Manson threatened J. T. Stewart with an action at law. J. T, Stewart instructed A. Burr to tarn the drnm out of th»township through Mr G. Trickiebank's drain , as it was a goo'l open, drain. Tn 1879 the Borouah Engineer dug a pecond drain, thto gn the r ilway and township, doing dam^e to me, to the extent of ore hundred pounds per i annum; stopping my works three months iv the year. The damage above mentioned was chiefly due to the Engineer m 1880, allowing a drain to be blocked up 2 feet by making a cartroad over the drain bnlow the English Church, and to complete the damage already done, by wilful neglect of the drain being kept open. Mr Haynes, Engineer, caused to be put a foot pf gravel and earth under the culvert below my house, to raise the road three feet above the level of the land on both sides of the road. On the 24th of April, 1883, the Engineer allowed a drain to be dag through the middle or my footpath within 3 feet of my fence fronting my.
house, aud bringing all the water from the bash on tha Manawata side into my property, and filling m the whole ot my works, as there i-? ten times the amount of water comes down the drain than a culvort 12 xl 2 can take off. Several of my family and others have fallen into the siid drain, and been seriously hurt. I have eight hundred pounds worth of machinery and shoda erected under special privileges, which have been damaged year by year. I have been complaining voar by year to the Borough Engineers, aod on Monday, May Ist, 1883, Mr Armstrong Borough Engineer, informed me I must take an act.ion to obtain redre3?.
