[Before S. L. Muller, Esq., R.M.] Wednesday, November 28. Smith v. Marsh. This was an action to recover £4 2s. Bd. for goods supplied.— Defendant disputed the account, stating that he had not received the whole of thegoods charged for.—Judgment for plaintiff, for amount and costs. Cavanagh v. Smith. An action to recover £1 for bringing goods from the Boulder Bank. —Plaintiff admitted that he gave defendant his watch, and defendant gave him 305., and receipted a bill he owed him for meat amounting to £1 ss.—Defendant denied that he owed the account j had settled it by receipting a bill plaintiff owed him for meat, giving him 80s, to boot, and receiving a watch from him ; valued the watch at 80s.; produced letters from a man who took the watch to Nelson to get it repaired, in which he valued it at 30s. Judgment for defendant. Plaintiff to pay costs. Day v. Minchin. —An action to recover £ll Bs. 6d. for wages and firewood suppliedDefendant admitted the debt, but said he had paid £2 4s. on account of plaintiff, which plaintiff admitted. —Judgment for plaintiff for £9 4s. 6d. and costs. Defendant to pay in one month. Carroll v. Clarke. —An action to recover £2O for refreshments.- —The proof of delivery of summons being given, and defendant not appearing when called, judgment was given for plaintiff for debt and costs. Smith v. Cavanagh.—This was an action for £2 2s for meat supplied.—Plaintiff agreed to withdraw his case. Carroll v. Antoine.—James Smith Carroll, being sworn, said; Defendant owes me £ll Os. 9d., balance of account. The original account is for £4l Os. 9d.—Defendant denied owing the amount sued for, and the original sum being above the amount allowed to be sued for in a Resident Magistrate’s Court, the case was dismissed, plaintiff being told to take the case into the District Court. Symons and Co. v. Brett.—An action torecover £IG 3s. Od. for goods supplied.. Service of summons having been proved,, and defendant not appearing when called on, judgment was given for plaintiff) for amount and costs.
