Mr. Foley pleadeVi that he Was not liable, but did not deny cl« facts. He said that his Company were not able to picent the misuhief uutil the completion of a water race that they were bringirg in for flushing. The Wardeu held that the Muddy Creek Company having obtained the grant of a channel and special claim had undertaken the responsibility, and must be held liable for the mischief. Fined £10;
Agricultural Lease.—William M'Devitt apK plied for sections 9, 11, and 25, block hi t Blackafone Hill. The application was opposed by Turner and Annitage, miners, and by the St.; Bath:in9 Mining Association, as regarded sections 11 and 9, which Were alleged to be auriferous. After hearing evidence, the Warden decided to refuse the grant of sections 11 and 9, and expressed his intention that those sections and 60me others in the siine line should be reserved for mining purposes. Section 25 was granted—ai ea, 48a. Or. 19p. The application of W. Williams and othere for the Continually-Xrying-but-so-fur-Uhfor-tunite Company, for four acres on the east side of Shepherd's Hut Gully, Cambrian, was considered, and there being no objection, the Warden decided to grant a certificate, subject to survey.
