WARDEN'S COURT.
Nov. 24. (Before H. W. Kobinson, Esq., Warden.) Police v. Ah Hin and Ah Pan. —Complaint for mining without miners' riglr sat Spec Gully. Ah Hin not served; Ah Pan fined ss. Police v. Hock Go On, Hock Fawn, Ah Ho, and Ah Thew.—For mining without miners' rights. Ah Thew, who did not appear to the summons, was fined 205., and lis. costs, and the above three u.en ss. each. Jnder and Guffie v. Andrew White and others.—For unlawful interference with a tail race at Clarke s Gully. Mr. Howlatt for complainants, and Mr. Hertslet for defendants. Complaint was proved, but the Warden, considering the interference had caused no mischief, imposed the minimum fine of'ls., with 335. costs, 40s. expenses of witnesses, and 21s. professional fee—defendant being, by consent, allowed tine to shift, two boxes,, the placing of which had led.to the complaint. Guffie and Inder v. GraysoD and Peterson.—For damage to a head race, known as the Kyeburn race, at Mount Burster. Mr. Howlatt for complainants, Mr. Hertslet for defendants. The damage in this instance had been occasioned by a discharge from certain pipes, by which defendant's race water was cooveyed along the back of the race in occupation of complainants. £2O damages were claimed. It was attempted to be shown, for the defence, that the mischief had been really caused by the breaking away of complainants race, whereby defendants' pipes had been allowed to fall; but the Court held the complaint to be sustained, and gave judgment for the full amount claimed, with 275. costs, 40s. expenses of three witnesses, and 425. professional costs. Guffie and Inder v. Andrew White and others. —Mr. Sowlatt for complainants, Mr. Hertslet for defendants. For inter- , ference with and encroachment upon complainants' tail race, by discharging water and tailings into it. Damages claimed, £SO. Hearing of this case was adjourned, to the 27th. Guffie and Ind<?r t. Knud Sand©.— Claim for £2O due. No appearance of defendant. Judgment for amount claimed, with 245. costs, and 21s. professional feeNov. 27. A (BefoioH. "W. Robinson, Esq., Warden.) 1 Guffie and Inder v. Andrew White and ~ others. Adjourned from the 24th. Mr. Kowlatt for complainants, Mr. Hertslet for defendants. A good deal of evidence of a very conflicting nature was taken in this case, and the judgment of the Court was, that the defendant pay £2O damages,, with 335. costs, 40s. expenses of two witnesses, and 425. professional fee.
