WARDEN'S COURT.
July 17. (Before H. A. Stratford, Esq., Warden.) Robert Donnelly v. the Hit or Miss Company, registered (Henry Anderson, manager).—For having left a head race entirely unused, for about two-and-a-half years, and praying for an order of the Court that the said race should be forfeited. Mr. W. li. Bailey for the complaint, Mr. Rowlatt for the defence. By consent of the counsel for the defence, Mr. Bailey amended the complaint, and served a fresh summons upon the defendant. Lancelot Hore was then calltd as the first witness, and, after his evidence -had been taken, the case was adjourned until the afternoon for the appearance of the complainant, and subsequently, as he didnot appear, Mr. Bailey applied for an adjournment until 11 a.m. on the 24th instant, |vhich was granted conditionally—that he paid forthwith, £1 10s. to the defendant to cover his own expenses, and the professional fee of £1 Is. Case adjourned.
