LkanTno'Rock:—The-Board considered. a -letter from t Mr. O. T, Murie, relative' to hisapplication . for .a coal lease of section Jl7, block IT, Leaning Rock. 'Mr. Gillies, of Messrs. Gillies and Street, appeared ■■; in '"'support of the application. It was opposed by Messrs. Seivwriglit and Stout, on'behalf of Miv M'Lellan. Cairns, tbiva lease of- the Islands of the -Waituki,' between Maere-' whenua and Kuro, for grazing purposes The present use of the country simply amounted to a day's shooting of-rabbits to a fewipersons in the'-■■neighborhood. ton, instructed by Messrs. White, applied to have issued to them a lease of run 324 Mr. Anderson, of Messrs. Smith 'and Anderson, opposed the application on behalf of the M'Kellar Brothers. It will be remembered that an action in regard to this run was recently tried in the Supreme Court.—The jury, Mr. -Barton stated, gave as parr, of the damages £IO.OOO for injuries sustained by the loss of the lease, but contingently that the lease was- not granted to the Whites on a day named by the jury. That day had passed, but of which fact there was no desire to take advantage. The learned "council for the M'Kellars had stated durthe couise of the trial that there ought to be no difficulty in 'obtaining a lease from the Board, and in respect of which' the jury should not give any damages—Mr. Anderson opposed the application-on the ground that the case was. subjudice. There had been, merely a .verdict of the i jury, and no decree. The license stood in the' joint names, and the Board had no power at present to issue a separa'e license to' either party. Mr. Barton's "clients would also have their remedy if the application .should be improperly opposed. —The Commissioner said the Board could not well act without legal advice.— No order made. •
