HYDE.—Feb. 19.
In the Resident Magistrate's Court, the only business was the granting of a slaughtering license to James Eamsay. "Warden's Cotjbt. (Before H. W. Bobinson, Esq., Warden.) ' Angus M'Kay v. W. Annet —This was a complaint for unlawful interference with a road in common use, by fencing across the same. Mr. Bailey for complainant, Mr. Eowlatfc for defendant. The circumstances of the case were, that the defendr ant having obtained the consent of the manager of the Taieri Lake Station, had fenced in a piece of ground, including a road which led past the complainant's residence area. For the defence it was contended that the complainant, if he chose to shift his gate, could still get a way into his premises. The defendant also read a letter from the station manager, professing to authorise him to shift the road. The Warden went to visit the ground, and finding the complaint fully established, imposed a penalty of £2 and costs, Bs., with 10s. expenses of complainant.
Mining Lease. The application of Angus M'Xay, for a mining lease, was withdrawn.
