"Warden's Couet.—Nov. 26. (Before H. W. Robinson, Esq., Warden). Howe and others v. Frater.—For cancellation of water license No. 61. Withdrawn. Same v. same.—For cancellation cf water license No. 62, for race formerly known hs the Enterprise Company, on the ground that the' defendant had neglected, for the twelvemonths last past, to construct the same. Mr. Rowiatt for plaintiffs. This case was only partly heard. Some evidence was taken, nnd the further hearing was adjourned by request of complainants, to Saturday, November 30, at the Court House, Naseby. Robert Campbell v. Ashcroft and John Robinson —For cancellation of water license No. 1811, and forfeiture of the race from Otekaike River to point near Basalt Hill, on thfr ground that the race had not been used for a lengthened period, and that the license had oeen allowed to expire without renewal. No appearance of defendants. Judgment: that the license No. 1811, of date 26th Februarv, 1870, be forfeited, and the registration thereof cancelled ; and all rights of defendants to the water race constriieteH under the authority of the said license be forfeited.
Ihe Hon. R. Campbell's Land Application. —The War Jen read a letter from the G-uld-fields Department, Dunedin, authorising him to continue to receive and deal with applications for mining privileges within the block surveyed for Mr. Campbell. Grants.—T. Cooper, resHenee area; J. Frater, extension of water races ; J. M'Quade, protection ; jyirno and otliers, tail race.
Withdrawn.—J. Frater, applications for water races from the Benlomond Creek and its tributaries j A. Ancell, seven applications for water races from the Maerewhenua, BenLomonJ, &c. ; H. Howe and Co., water race.
