■ Warden's Court. (Before XL. W. Robinson, Esq!, Warden.)

Ticrnan v. Turner and- Gray.—This was a demand for the sua. of £B, ralue of a Hume box, joint property of plaintiff and defendants, which it was alleged the defendants had converted" tio their own use. The evidence allowed that the box had been placed to-carry the defendants' race over that of the pl.iinti.Ts, and had been erected at joint expense. The defendants had . lowered the level of their race so as to pass under instead of over that of the plaintiffs, and had used the material of the old box to make a box of different dimensions to carry plaintiff's race.,, over r.heir's. The Court held that- this* was a conversion, as the defendants were clearly bound to provide a box themselves, if for their own convenience they changed the levels. Judgment was given for £i, being proportionate value of box.
