(Before His Honor Wilson Gray.)

In the appeal case Greer v. M'Grath, heard at. the last s-itting of the Court, his Honor said he was not yet prepared to give, judgment, though : he hoped to be able to do so before leaving. Douglas and party, appellants; Christian Archer, respondent.—This was ah 'appeal from the de ision of the "Warklen and Assessors. The case, a full report of -which appeared in our issue, of th.e 2oth ultimo, was first heard as: Christian Archer v. Douglas arid others,'; when the case was dismissed A re- ] hearing was subsequently granted, and:j the case was again heard on the 22nd \ ultimo, before the -AVarden and Asses- j sors, when the judgment was reversed,! and a verdict for £llO and costs recorded. This judgtneut it was now sought to upset on appeal, on the ground- that it was against evidence and against the direction of the Warden. The case occupied the Court till nearly 1L p.m., and was adjourned till Friday morning. With the exception of one or two legal points which were raised on the part of the respondent, and which were reserved by his Honor, the case was in all esseutial points the same as previously reported. Mr. Bailey for appellants, Mr. llowlatt for respondents.
