WARDEN'S COURT.—Nov. 7.
(Before 11. W. Robinson, Esq., Warden.) Edward Carling, as Manager of the Extended Water Race and Sluicing Company (Registered), v. T. Gallagher and party. —This was a complaint that defendants had, upon the 24th ultimo, run tailings and tail water into their registered tail race, contrary to the Goldfields Rules and Regulations, and asking that a penalty of £5 should be in.ttiq.ted and an injunction issued to prohibit further interference. No evidence was called. Gallagher, who appeared personally,admitting the charge, but asserting that he had a right so to do. An endorsement upon a tail race certificate, upon which defendant relied, failing to establish any such right, a penalty of 20s. was inflicted, the Warden remarking that he would not on the present occasion go to'the extreme length of issuing an injunction, and ex-, pressing a hope that a satisfactory arrangement would be arrived at. Mr. Hertslet represented the Manager of the Extended Company.
