WARDEN'S COURT.

Thursday, 13th April. (Before H. W. Robinson, Esq., Warden.) Application for Agricultural Lease.. —This was an application by Joseph Preston for a lease of land for agricultural'purposes, situate at Swihburn,on IRun JNo. 293, and comprising 502 acres. ]S r o objection. Granted upon the payment of the usual rent and the expense ■of survey, £8 sk. Byrne and Others v. Martin Noon. —The complaint in this case was that the defendant did, on the 31st March, and on the Ist, 3rd, and 4th April, unlawfully run tailings and tail water on tne claim, and into the tail race of complainants, situate in Golden Gully, Serpentine, and thereby done damage to the extent of £3O sterling. Case ■dismissed A. further report will appear in our next issue. Cleary and Party v. O'Loughlen.— This was a suit to recover the sum of .£2O for damages alleged to have been sustained from tailings and tail water having been allowed to flow from the workings of defendant on Surface Hill into the tail race of complainant, in Main Gully, between the Ist day of March and the 6fch day of April. The case, which occupied the Court till a late hour, resulted in a judgment of Is. ■without cost*. Mr. Eo'ss for complain.ant, Mr. O'Loughlen for the defence.
