WARDEN'S COURT.

Thursday, November 10. (Before H. W. Robinson, Esq., Warden.) Macnamara v. Creighton.—This was an action to recover the sum of thirty pounds sterling, damages alleged, to have been suffered by plaintiff in consequence of several interferences with plaintiff's tail-race in Enterprise Gully. For the defence, it was sought to be established that the portion of the race with which defendant" had interfered was not the property of the plaintiff, he holding no registration certificate ; that the defendant held a certificate for the race in question, and had therefore a, lawful right to be there and do as he had done. The case, which was tried before assessors, occupied the Court from 11 a.m. till midnight, when the assessors, who had, in company with the Warden, visited the ground during the day, returned a verdict for plaintiff —£s damages with costs.
