ITINENANT TRADERS FEES
LICENSE MUST BE FOR COMPLETE YEAR.
An interesting position with reard to itinerant traders fees was
disclosed at last night’s Borough Council meeting when the Afunicipal Association secretary wrote drawing the Council’s attention to the decision given by Air. Justice
Osier in the ease Laird v. Dimond and Hart, decided on the 17th October last. It was held in this case that- every lie’ense foY an itinerant trader must be issued for „the period of one. year, there being no power given by the Municipal Corporations Act 1920, to grant a license for a part, of a year. There was accordingly no power to make a by-law imposing a license fee of £5 for an itinerant trader’s license
to expire on the 31st March next ensuing irrespective of the date upon which the license was taken out. The 'by-law must therefore provide that the license shall remain in force for one year from Ihe date of issue. Unless the above decision is reversed by a higher court any opinions given by the Association to the effect that the license is issued once and for all and is not receivable annually must be disregarded. The Clerk, in explaining the difference between itinerant traders and itinerant hawkers, said the 'matter did not greatly effect the Council.
