MAGISTRATE’S COURT.

MONTHLY 'SITTING

The usual monthly sitting of the local S.M. .Court- was held this morning before Mr. J. L. Stout, S.M. NOISY EXHAUST. Arthur R. Lorvejoy was charged with riding a noisy motor in Main Street on September 27th. • Constable Lincoln gave evidence to the effect that the cycle was giving undue noise. There was no silencer on the machine. Accused was fined £1 with costs 19/CIVIL CASES. Judgment was given for plaintiff in the following civil undefended cases:— O. J. Olsen (Mr. Bergin) v. T. Sim £l6 2/-, costs ■£2 , 9/-; and order for possession of dwelling on or before the 27th inst.; 11. E. Garbett (Mr. Bergin) v. T. Tuna £6 3/11, costs £1 15/6; same v. T. Ellers £<> 12/8, costs £1 15/0; S. Mai la r (Mr. IRergin) v. C. J. Cliesham £6 0/6' costs .61 12/6. J UiDGiiVi ENT SUM.M( )NS. In the judgment summons Ciochot.to and Co. v. J. Mills £2l 3/8, previously adjourned for six months, defendant under crossexamination bv Mr. Bergin said he was working on a third share for Mr. Tim*ll at Moiitoa. Tlie cows wore coming in late ami on account of that he could not pay anything off the account. Some months he showed a deficiency of 65. He had four children. The balance of the cows should be in any time now when the position -hould improve.

The S.M. asked if defendant could pay a little off the account monthly, but Mills said lie had got so far ha die that he could make no offer. He had not had a pound for himself for seven months’ work. Asked how much he expected would lie coming in from now on Mills stated that lie did not think lie would receive more than £2O. Cows would not average £1 a. head per month, on the present price of butterfat. The case was adjourned until the 12tii February. DEFENDED IGLVIL CASE. Frederick Robinson proceeded against Sidney Joint Easton for the recovery of £25, allegedly due for breaking, stabling and feeding a horse belonging to defendant. After the hearing of lengthy evidence (an aeeout of which will appear in our next issue) judgment was given for defendant with costs.
