INCREASED VIGILANCE ON BITUMEN ROADS.
CHIEF JUSTICE’S WARNING TO
NIGHT DRIVERS,
•The duty of motorists to exercise increased care when driving on bitumen roads at night was emphasised by, tlie Chief Justice (the Hon. AI. Alyors) during a summing up in a damages claim in the Supreme Court at Wellington on-Mon-day. Counsel had- said and correctly, stated his Honour, because it was known to every motorist, that it was difficult at. times to notice pedestrians on bitumen roads. It was difficult, but lie was going to tell the jury, and lie was going to repeat it in all similar cases, until be was told by a higher Court that he was wirong, that the necessity for vigilance on the part of the motorist was increased, and not decreased, by the very fact that bitumen roads weiie made really for the convenience of motor traffic, and it was difficult at times for the motorists to see pea-sons on them at night. If that were not so it might give the motorist a license, which, as lie viewed the matter, the law did not give him, and lie hoped never would.
