MALICIOUS CHARGE
WIDOW AWARDED DAMAGES. Hamilton, Sept. 5. Having been accused of theft, arrested, tried, and acquitted, Mrs. Bertha Prescott, a widow, of Huntly, known as Mrs. Watson, sued her accuser, A. E. Powell; a theatre proprietor, for £IOOO damages and legal expenses. Plaintiff alleged that the charge preferred was malicious and made without reasonable and probable cause.
The case was tried before Mr. Justice Ostler and a jury to-day.' The hearing lasted the whole day, and the jury found malice and a lack of treasonable or probable cause for the theft charge, and awarded plaintiff £350 damages. The case was adjourned till Tuesday for legal argument.
