S.M. COURT

MONTHLY SITTING. The usual monthly sitting of the local Magistrate’s Court was held this morning before Mr. J. L. Stout, S.M. BREACH OF PRO'HIIBiETION ORDER. L. J. Andrews charged with a breach of his prohibition order was fined £1 with costs 10/-. UNREGISTERED AUTOMATIC PISTOL. F. J. Moffatt, of Oroua Downs, was charged (1) with being in possession of an unregistered automatic pistol, and (2) with, not being a licensed dealer, did have in his possession fojr more than seven days, an unregistered pistol. Moffatt pleaded guilty to both charges. 'Constable Owen in evidence, said that accused was a returned soldier who had brought home from the war a German automatic pistol which was duly registered in accordance with the regulation on .January 7, 1921. Three months ago, however, word was received from headquarters to maike an inspection of all automatics and papers. Wthen Moffatt was interviewed he was unable to locate his papers. He was given the option of re-registering the firearm or handing it over to the Crown. He decided on the latter course. He took a pistol in to the Palmerston North police station and handed it over but on checking the registration papers it was dis-c-ovejred the pistol did not tally with the one registered. Accused was interviewed and said that he had two pistols, one of which belonged to a mate of his who was killed in the .Ongarue railway smash. This pistol had never been registered and the wrong one was evidently handed in. Confiscation of the other pistol would have to be made. The S.M. said the case did not call for a penalty and accused was ordered to pay costs £1 2/1, and an order made for the confiscation of the other pistol. CLAIM FOR RENT.

The adjourned civil case, J. McICnight v. T. Wanklyn in a claim for £l3 5/- folr rent was concluded. Mr. Bergin, who appeared for plaintiff, said that he had checked his client’s receipt butt and also the receipts held by defendant and a pocket book in whieli defendant kept tally of his payments. There was a difference of £2 between defendant’s books and those of plaintiff. Defendant had entered a payment on a certain date but had no receipt for. the amount. Plaintiff would swear 'he never received the amount and defendant was prepared to swear that he had paid it. If defendant did .not pay it he intended to do so. There was no attempt to make the record “crooked.” The S.M. gave judgment for £ll 5/- with costs £3 1/-. CIVIL OASES. Judgment was given for defendant in the following undefended civil cases: — F. G. Takarua v. A. K. T. Love, £3, costs £1 11/6; A. Stank and Co. v. H. D. Dawson, £6 5/6, costs £1 10/6; State Advances Superintendent v. D. Williams for costs 18/- and order made for possession of tenement; A. Fraser v. A. E. McKenna, £26 0/6, costs £2 16/-, and order for possession; H. Osborne v. Davey Biros. £lO 9/3, costs £2 17/-; A. G. Coughtrey v. E. Bevan, 12/6, costs &/-; same v. H. Kie, £4 18/6, costs £1 10/6; same v. 11. Mihaka, £2 3/-, costs £1 12/6; same v. P. Tamiliana, £5 19/6, costs £1 19/6; E. Wanklyn vj. G. T. (EL Hallj, £22 18/11, costs £1 16/- and order for possession. JUDGMENT SUMMONSES. Len 'Stevens was ordered to pay Van Stavejren Bros., Ltd., £34 3/fartkwith, in default 28 days’ imprisonment, warrant suspended as long as defendant pays £5 every four weeks. Matu Riiruku was ordered to pay A. M. Essex £l4 16/- forthwith, ill default 14 days’ imprisonment, warrant suspended as long as defendant pays £1 per month. BREACH OF THE BY-LAWS. Wi Raumiati Hone charged with cycling in the Borough in the dark without a light was convicted and fined 5/-, with costs 10/-.
