CHAR-A-BANC DRIVER ASSAULTED.
BY PASSENGER WHO REFUND TO PAY FARE. £5 FINE INFLICTED. At the local S.M. Court on Thursday, before Mr. J. L. Stout, SAL, A. V. B Madden Avas charged with assaulting John Leo O’Reilly, driver of Messrs Madge Bros. Foxtoil-Pal-merston North char-a-banc. Madden did not appear but pleaded guilty by letter., Constable Owen said accused was asked for his fare prior to the char-a-banc leaving Palmerston North for Foxton. He was in an intoxicated condition but said he would pay on reaching Oroua Downs. When his destination Avas reached accused refused to pay and when the driver endeavoured to retain possession of accused’s suit case a rough and tumble ensued. John Leo O’Reilly, char-a-bane driver, in evidence, stated that defendant got on the bus at Palmerston North and told witness that he wished to go to Mr. Raikes at Oroua DoAvns. Before the bus reached Mr. Raikes’ property, accused Avanted to get out. Witness stopped the char-a-bane to let him down and pointed out that they had not yet reached Mr. Raikes' place. Accused retorted that he did not not knoAV Mr. Raikes and refused to pay his fare. Thereupon Avitness grabbed accused’s suit case and placed it back in the bus. A rough and tumble ensued but Avitness got aAvay and' Avent back to the char-a-bane. Accused followed him into the bus and the passengers had to assist in removing him from the vehicle. Witness’s coat was tom in the scuffle. Witness saw accused on the return trip but no moation was made of the fare. The S.M. convicted and fined Madden £5, half of which was to go to the driver.
