VARIATION OF MAINTENANCE ORDER.
UNDER PECULIAR CIRCUMSTANCES.

“Do you mean to say that if a man deliberately deprives himself of his property the Court should vary the orders?” asked Magistrate Lawry of counsel appearing for John Duncan, who applied for reduction of a maintenance order of three pounds weekly in respect of his wife and children. /•■ ■When the order was madr' # ' r)uncan was a farmer at Kir wee, L .it, on the night after Court proceedings he paid; off his form hands and fifed /his house, buildings and stacks. His son was found dead in a water race and Duncan was arrested on a charge of murder. But the evidence at the inquest disclosed that death was due to natural causes.
In Court to-day it was argued that Duncan was suffering from a wound in the hand and would he unable to work for three months. It was also argued that if 1 all his property were taken to satisfy the maintenance order Duncan would be unable to start again. The order was reduced from £3 to £2 5/- weekly.
