BOLTON DIVORCE CASE

The Pahiatua divorce ease, Bolton v. Bolton wherein Felix Stuart Hindmarsh Bolton petitioned for the divorce of Eileen Margaret Bolton on the ground of alleged adultery, was concluded before Mr. Justice Ostler, at the Palmerston North Supreme Court on Tuesday. The issues submitted to the jury were as follow: (1) That adultery had taken place, and (2) that there had been connivance on ,the part of petitioner, it being alleged by counsel for respondent that petitioner had given his aid so that respondent and Hewitt might meet with the intention of committing adultery. The jury returned after an absence of an hour and ten minutes and answered “Yes” on the first issue and “No” on the second, adding a rider -that the careless and neglectful conduct of petitioner may have contributed to his wife’s misconduct. DECREE NISI GRANTED. Palmerston North, Yesterday. In the Bolton divorce case his Honour Mr. Justice Ostler granted a decree nisi, saying he was satisfied the verdict of the jury meant that there had been adultery, and no connivance. An application was made by petitioner's counsel for costs against Hewitt. On this question his Honour reserved his decision. Leave was granted counsel for respondent up to January to ask for a new trial.
