THE TIMARU SHOOTING CASE.
COURT REFUSES TO ACCEPT PLEA OF GUILTY. Oaniaru, Last Night. As the outcome of the quarrel between two brothers, Alan and Herbert Symon, on May 28, the former aged 174, stood in the dock at the Magistrate's Court to-day charged with attempting to murder Ills brother who received a bullet from a pea-rifle in the neck. Evidence showed that accused’s mentality was subnormal and he was subject to fits of violent temper. While being searched at the Police Station accused is alleged to have said: “1 have often told him he would -gel something like this. He is stronger than the rest of us and is always pulling us about.”
On behalf of accused Mr. A. Hamilton pleaded guilty. But Magistrate H. W. Bundle said that in view of accused’s mental condition he would enter a plea of not guilty.
Mr. Bundle added that he would recommend the Minister of Justice to have accuse! placed under observation at the mental hospital in the meantime and committed him for trial at the next sitting of the Supreme Court at Oamaru.
