COUNSEL’S QUEER ARGUMENT

LONDON, May 4. A ease arising out of an exhibition of sapphires at Wembley occupied the courts to-day when" Harry McCrae Burnside, formerly in business in Australia, and trading in England as Burnside and Company since 1920, sued Mrs E. M. Jenkins and her husband for alleged libel. Plaintiff said that Mrs Jenkins wrote to Mr H. Knowles, the Queensland Government’s gem expert, calling Burnside a mongrel, and describing his exhibit as a disgrace to Queensland. It was also suggested that the gems were reconstructed sapphires. Counsel said that Mrs Jenkins honestly believed what she wrote.

A term like ‘‘mongrel,” counsel added, would be used almost as a term of endearment by Australians. Burnside was awarded £IOO damages.
