FIGHT LEADS TO ACCIDENT.
STEWARD’S CLAIM FAILS.
Auckland, October 8.
The case of a steward on the steamer Rarawa', who fell downstairs and broke his leg a few minutes after getting, the worst of a fight, was considered by the Arbitration Court yesterday. The steward, Percy Clarence Earl, brought a claim under the Workers’ Compensation Act, against the Northern Steamship Co. Ltd., alleging that he had been totally incapacitated from following his occupation since the accident. Giving judgment this morning, Mr Justice Frazer said that the Court was satisfied that plaintiff was sober when he went back to his ship. It was difficult to know why he had entered into such a violent fight. The fact remained, however, that he had unjustifiably attacked Davis (another steward). The Court was satisfied that the accident.was a consequence of the fight, and in the circumstances judgment would be entered for defendant company.
