CHARGE AGAINST DOCTOR DISMISSED.
NO EVIDENCE OE INCITEMENT.

The Magistrate, Mr Page, in a reserved judgment, dismissed the case against Dr. Jacobsen, of inciting a young woman to permit the use of an instrument or other unlawful means to prorure a certain result. He quoted authorities to show that an accused person could not be convicted of such an offence unless the crime incited to be. committed had actually taken place. The crime alleged to. have been incited had not been committed. There was no doubt the conduct of the accused in giving an address had resulted in a girl going to the woman, but he could not be charged with aiding s or abetting. He found no evidence of persuasion or dissuasioni There was no evidence to go to a jury on the charge of inciting.
