Ilawera, January 28,

Hugh Rodger was charged in the Magistrate’s Court to-day with being found in a state of intoxication while in charge of a motor-car. The evidence was to the effect that Rodger was endeavouring to start the engine, but was staggering, and was unable to do so. A companion, also alleged to be intoxicated, tried to assist, but without success.

Defending counsel submitted that under the section under which the charge was laid, the vehicle must be in motion, and that an offence was only created when the car was capable of creating damage. The Magistrate (Mr Barton) said that there was an English, and he thought, a New Zealand case, also, which laid down that an offence was created whether the car was moving or stationary. Rodger was convicted and fined £lO. His current driver’s license was cancelled, and he was disqualified from holding a driver’s license for five years.
