£5 DEPOSIT TO ENSURE £BO LOAN. INDICTABLE CHARGE DISMISSED. W anganui, Last Night, A case of much local interest came before Mr. Barton, S M., today, when Wliarekura Ximoti, a Maori, brought an action against li. W. Downes, a director of the Batumi Bank, for allegedly obtaining money under false pretences. The case centred round a transaction which took place a considerable time ago between the informant and Downes. After some discussion by counsel, the civil clement was waived and the action proceeded as an indictable one. The informant, in evidence, said he deposited £5 in the Katana Bank, for which lie received coupons. He paid in the money in order to receive a loan of £BO to which nis deposit was represented to eniitle him. Some two months later, when he went to Downs for the loan, the latter told him that no money was available. The Magistrate said that on the information before him he could not see where a case of false pretences lay. it seemed to him that the matter involved a breach of contract and therefore was purely a civil matter. The information would therefore be dismissed.
