HEAVY TRAFFIC BY-LAWS.
LICENSE FEE MUST BE PAID. Arising out of the recent appeal in (he ease of Berry v. N. I. W. Brown and Co., of Rongolea, wherein the Judge upheld the-Magistrate’s decision that the defendant company Avas hound to pay heavy traffic license, application Avas made before Mr R. M. Watson, S.M., at Feilding on Thursday, for a decision in the other eases which Avere taken at Ihe same time, as.that against Brown and Co. The defendants were A. Wilson, A. W. Stevenson and the Foxton Distributing Co.
Mr L. A. Elliott, avlio represented the Manawatu County Council, recalled that His Worship’s decision had been upheld, but stated that so far the owners of the lorries concerned had ignored the Council and had not taken any steps to obtain tlie license. No penalty had been imposed in the case of N. 1. W. BroAvn and Co., as the ease was treated as a lest one, and counsel desired lo have Ilis Worship’s decision respecting the other eases. Mr J. Graham, who represented N. T. W. Brown and Co.’, as well as the Foxton Distributing Co., submitted that in Iho {'jreimistanees no penally should lie imposed on the Distributing Co., whose case was similar to that of Brown and Co. Mr T. Pagan, who represented A. Wilson, entered a similar plea, and said that lie would advise his client that lie must obtain the license and pay the fee prescribed in the bylaw.
The Magistrate did not think there was any need for the infliction of a penalty. However, the cases would be adjourned for a fortnight to enable the defendants to pay their license fees. Mr Elliott concurred in the adjournment.
