LIBEL ACTION

PLAINTIFF AWARDED £SO DAMAGES. Gisborne, Yesterday. At the Magistrate’s Court at Toko m aru Bay, Frederick Louis Thomas, manager of the Tokomaru Freezing Works, sued Robert Cribben, late proprietor of the “East Coast Watch,” for £75 as damages for alleged libel in a report in a police court case in which the plaintiff was one of the presiding Justices and editorial comments thereon. After lengthy evidence, the Magistrate, Mr Levvey, S.M., in giving his verdict for the plaintiff for £SO, said that the real question at issue was whether a certain statement had been made by the plaintiff. The evidence showed that the words were never used and lie therefore considered that the insertion of a paragraph by the defendant in the report was wrongful, and he characterised the leading article as scurrilous in tone and quite unjust .
