MAGISTRATE’S COURT.

MONTHLY SITTING. The monthly sitting of the S.M. Court was held yesterday, before Mr J. L. Stout, S.M. BY-LAW CASES. Harry Burrows, of Palmerston North, was charged with driving a ear in the Lady’s Mile, on Sunday, November 18th, 1923, at a. speed in excess of the borough speed limit, Defendant pleaded not guilty and was represented'by Mr Oram. Mr Bergin represented the Municipality. William Neville, traffic inspector, gave evidence as to putting the watch on Burrows’ ear on the morning in question and stated that the speed the ear was travelling at was 31 miles per hour. Mr MeKnight gave corroborative evidence. H. Burrows gave evidence that just previously to being stopped on the Sunday morning he was travelling at 19 miles per hour, above which pace lie had not. gone during his drive from Palmerston North, owing to having, nervous passengers on board. Another .car had passed hm just before he was stopped by the constable. Counsel for defendant, contended that a mistake had been made and Burrows’ ear had been stopped on the time of the ear that had passed him. The S.M. pointed out that there was no room for a mistake in his opinion as the other car did not pass Burrows’ car until it. was out of the eight chains laid off for timing. . There had been no mistake over the number’. Fined £2 with 9/- costs and £1 1/- solicitor's fee. William Thomber, for riding a bicycle on a footpath within the borough on 10th December, 1923, was fined 10/- and costs 7/-. CIVIL CASES. Judgment was entered up for the plaintiff' in the following civil undefended cases:— p W. D. Hastie v. J. E. Coley, claim £27 7/-, costs £2 15/-; order for possession on or before 14tli February. JUDGMENT SUMMONSES. Judgment was reserved in the case F. S. Easton v. H. F. V. Millar, claim for £122 13/6, after the hearing of lengthy evidence as to agreements etc. Mr Bergin appeared for plaintiff and Mr Cooper for defendant. F. J. Carmont v. Tumeki Wehi Peihana, claim £l7 10/-, costs £2 19/-. Ordered to pay forthwith.
