THE MANAWATU-OROUA RIVER DISTRICT ACT. Notice is hereby given that Application is intended to be made to (he General Assembly of New Zealand at the forthcoming Session thereof for leave to introduce on behalf of the Mnnawatu-Oroua River Board a Bill entitled “An Act to make provision for the improvement of the waterways of the Manawatu River and the Oroua River and for the protection from damage by water of certain lands in the Wellington District.” The object which such Bill is intended to effect is to create a. special river district to be called “The Manawatu-Oroua River District,” to be divided into five subdivisions consisting of nine I members, one of whom represents the Oroua Subdivision, two of whom represent the Kairanga Subdivision, three of whom represent the Makerua Subdivision, one of whom represents the Koputaroa Subdivision, and two of whom represent, the Mouton. Subdivision, appointing the members already elected for the Manawatu-Oroua River Board to be the members of the new Board until next election, and appointing the Chairman to be Chairman until the next election; confirming the exercise by the late Board of powers and confirming its appointments and validating all loans, and borrowing by the late Board; all property of the late Board to become the property <>P tlie River Board incorporating 1 the River Boards Act, 1008, as varied or extended by the proposed Act; also empowering the Board to do all things as nre necessary in its opinion to prevent or minimise flooding of the district and in particular to divert drains, streams, or rivers and close up inlets and outlets; to construct and maintain overflow channels, to purchase any protection works, machinery, nr assets of any local authority or ratepayer, the price in case of dispute to he fixed by arbitration and the purchase money to lie paid either by taking over part of the* special loan out of which anything purchased was constructed or bought or by the issue <>f debentures, nil debentures to be issued by the River Board in conformity with “The Local Bodies Loans .Act, 1013”; also to acquire lowlying tidal or waste land not owned by Local Authority or Harbour Boards within 3 miles of the district and to reclaim them; also to order removal of any obstruction in a river or stream or except buildings, within half a chain from the stream, which may obstruct the free flow of the river or damage or be likely t > damage the bed or banks of which
:•( '.'.strict or will be likely to constrict the channel, the power of the board in this respect extending' 1 mile beyond the upstream boundary of the district; also to plant shelter belts on tlie board’s land or with the consent of any other person on that person’s, so as to prevent sand drifts; the Act also provides that no person shall destroy or damage the shelter belts or any fences; also providing for notice to occupiers before the exercise of certain specified powers by the Board and providing that after hearing any objection the Board's decision shall be final; also promising that the ommission to send the notices shall not render illegal the exercise by the Board of the powers and that the provision as to notice shall not apply in respect of urgent work to meet an emergency; also providing against any person or (subject to the safeguards provided in the Act for all Local Authorities) Local Authority permitting drains to enter into the rivers or constructed drains of the River Board or erecting locks, tide gates, bridges, ferries, wharves or other works prejudicial to the Board’s operations without the Board’s approval; also providing that the Board’s jurisdiction does not apply to such matters where under the control of Harbour Boards; providing that in the case of a local authority desiring to make, erect or maintain any of the lastly mentioned drains or things, it shall give 14 days’ notice to the Board with full particulars; providing against erecting anything that will be likely to obstruct the free llow of Hood waters without the consent of the Board and in the case of a local authority requiring 1A day-'' notice with particulars of the work to lie carried out; providing that all protection banks, drains, overflow channels, tidal or flood gates, or other appliances or work or property carried out, acquired, maintained ur constructed by tlie Board shall be the Board's property; and providing that any person doing anything to damage or impair the efficiency of any such property or doing anything forbidden by the Act shall be liable to a penalty of £100; also providing that any person failing to comply with any order of the Board within 14 days from receipt shall he liable to a penalty of £5 a day and the cost of tlie work; that any order sent by registered letter shall be deemed to have been received within 24 hours after its arrival at the Post; Office of Address; also providing for tlie Board keeping hydrological records; also providing that the Board may enter on land with servants and carriages for the purpose of carrying out or maintaining any of its works; also providing for the purchase of land injuriously affected instead of paying compensation, and that in case of dispute tlie price shall be fixed by arbitration; also conferring on the Board power tu lease and transfer any land and providing for the application of the proceeds in or towards redemption of loans, payment for new work, payment of compensation for land taken or injuriously affected, also providing that where the works will be likely
