CRESSWELL v. CRESSWELL. His Honour, Mr Justice -Reed, continued the Palmerston North session of the Supreme Court on Saturday. Desertion and adultery were the grounds on which Edward Percy Cresswell, of Foxton (Mr Bergen), applied for a divorce from Margaret Cresswell, Joseph Mooney being cited as the co-respondent. Petitioner, a flaxcutter, said he had been married for a number of - yearSj and there were no children. Six years ago respondent left him for reasons lie was not aware of. She went to Wanganui, and later to Auckland. He had not cohabited with her since, nor had he supported her. Owen William Hughes, of the Brooks Detective Agency, Auckland, said that when he located respondent in Auckland she was living with co-respondent, as man and wife. Both admitted having committed adultery, and that they had been doing so for some time. The divorce papers were served on them in a bedroom they were both occupying at the time.

A decree nisi was granted. His Honour refused to make the costs against co-respondent, pointing out that it was not like a case where a man had taken the wife away, and thus broken a home. In this instance the wife appeared to be adrift at the time co-respondent met her. He should not to suffer in such circumstances.
