The prosecution alleged that accused had violently attacked Altmro with a spade, and injured him. Por the defence .Mr Cooper contended that there had been extreme provocation, hut, not wifhstandiny this, the act was committed in self-de-fence. His Honour told the jury that If they were salislied I hat accused had not. premeditated the act and had struck the blow in self-defence when allacked by the hoarder, they must acquit him. The Jury, after a retirement of In minutes, returned a verdict ol “not. yitillv.'* 'xot oniviT.” dames Kyle was eharyed that on Alav drd. I1)20, at \N oodville, hi 1 assaulted Charles Clarke Kiny, licensee of the Commercial Motel at Woodville, with inient to cause him actual hodily harm, and did cause actual hodily harm. Oram appeared, was arraigned mi four (dmryes of stealing liicydes, and one of slealiny y man’s overcoat. All the offences were alloyed to have occurred within six months of one another. Two of the bicycle thefts were alloyed to have taken place in Palmerston, and two in Peildiny. The overcoat was alloyed lo have been stolen in Palmerston Xorlh. The east' was still proceediny when the Court adjourned.
