Ifa worn, -Jan. 13., An ini cresting legal point was raised in Ilia Magistrale’s Court upon an application on behalf of a .judgment creditor for an order attaching' money.s lying to the judgment debtor’s credit at the Post Oflice Havings Bank. Counsel said an interlocutory order had been served upon the postal authorities, but was returned with a denial of the power of the Magistrate’s Court to make an order against the Department, on the ground that money deposited in the Post Office Savings Bank Avas I lie property of the CroAvn. There - fore the Magistrate’s Court had no jurisdiction to make an order. The CroAvn Avas not represented. The Magistrate, Mr Bailey, Avho reserved his decision, expressed the opinion that if the huv proved to he that moneys could not be attached it should be remedied, as it Avas extremely unfair that a debtor should be able to evade his creditors by locking up money in the Post Office Savings Bank.
