At (he local Police Court yesterday, before the Mayor (Mr J. Cliryshill) and Mr Hornblow, J.P., Peter Ellers was charged with assault by W. Hamer. Mr Bergen appeared for the accused, who pleaded not guilty. Mr Hamer said accused went to the Royal Theatre on Monday night, under the influence of liquor and in a quarrelsome mood. He put his hand on his shoulder and told him to go out, when accused struck him. Accused admitted striking Mr Hamer after the latter pushed him. He went to the Royal to ascertain whether any Natives were there. He may have had a drink or two, but was nut drunk. Mr Hamer pushed him violently, and sent him staggering for about four and a-half yards. After he gave Mr Hamer a “smack,” the latter picked up a chair and struck him with it. Evidence was given by Hines and Hakaraia. Defendant’s counsel submitted that an assault had been committed on defendant by plaintiff when he placed his hand on defendant.
