PROPOSED RAILWAY SIDING.

APPLICATION TO BOROUGH COUNCIL. At the October meeting of the Borough Council the local manager of the New Zealand Shipping Co., Ltd., made application for permission to put a railway line across Harbour SI reel and erect a siding on the Council’s properly on the northern side of Hie Company’s store. Sketch plans of the proposed line and siding were submitted. The mailer was referred to the Works Committee, and at Monday night’s meeting the Committee's recommendations as follows were submitted for consideration by (be Council: —“That negotiations be entered Into lie!ween (be Foxlon Borough Council aml the New Zealand Shipping Co., Ltd., on the (|ues(ion of a proposed railway siding across Harbour Street and into the Borough yard, on the following conditions: — (1) That the rails' shall lie laid over Harbour Street, as shown on plan submitted; (2) that the whole, eosl of all work in connection with the proposed siding shall lie borne by the New Zealand Shipping Co., Ltd., including re-eonslruetion of street where rails are laid, so that it shall not in any way impede vehicular I faille, the cost of maintenance of the street for six feet on either side of the railway track shall he borne by the said Company, who shall carry out all the work in eonnectiun therewith as (he Council may direct from time to time while the agreement is in operation; (3) that the New Zealand Shipping Co., Ltd., shall indemnify the Council against any claim for accidents arising from the working of rolling slock across Harbour Street; (4) the Company shall not in any way allow tracks to block traftic,; (5) that hi order lo safeguard pedestrians, the Company shall grant the free use of its right-of-way while agreement is in force; (ti) the Company shall find material and erect a gate nine feet wide by live feet high on the northern side of handroom, into the borough yard, and shall a No construct a wooden siding three feel high at the eastern end of shed on (he northern side of rails to allow metal to he unloaded from trucks; Die gate controlled by the Company shall always be kept locked except during working hours; (7) that in consideration of the free use of the Company's proposed siding to unload, if necessary, four trucks of metal per day, and the requisite length of rails laid to accommodate same in the borough yard, and a payment of £25 per annum, the Council is willing to grant the right lo construct the line on their property for a term of ten years, it being understood’ that all annual charges shall he paid by the Company; (8) any charges for demurrage made by the Kailway Department on Council’s goods arising through the fault of the Company shall he borne by the Company; {!)) any bread) or breaches oi above contract shall tie deemed by both parties to be sullieient grounds for cancelling contract and declaiming same null and void.” The Mayor moved, and Cr. Coley seconded, that the report he adopted. As an amendment, Cr McMurray moved, and Cr. Bryant seconded, that the annual charge he £5 per year, instead of £25. On the amendment. being put it was lost, the voting being: For, Crs. McMurray, Bryant, Hurley and Hannah. Against, The Mayor and Crs Coley, Henderson, Walker, Thompson and Kempster, The motion was then put and carried.
