SUNDAY TRADING NOT ILLEGAL.

IN CERTAIN CASES,

Wellington, Feb. 27/

An important, judgment, declaring in effect that Sunday trading in marble bars and similar establishments is not illegal was delivered in the Supreme Court by the Chief Justice to-day. The case was an appeal brought by the managers of three city establishments against the judgment given by Mr McCarthy, S.M., on a charge of keeping shops open on Sunday. The Magis Irate found that the shops w r ere open of necessity for the supply of refreshments to certain people. His Honour commented; In my opinion, therefore, the magistrate having found that the shops were open of necessity for some people to be supplied! ’with food, and as the offenc * charged is simply that of keeping open shops, and not selling goods, the appellants ought not have been convicted. In my opinion, therefore, the conviction is wrong, and. the appeals must be allowed. No costs were given.
